The Legal Aid, Sentencing and Punishment of Offenders Bill currently going through Parliament includes taking clinical negligence out of scope for legal aid and changes to the way that no-win no-fee arrangements work. The combined effect will, in our view, deny access to justice to some of the needy and deserving victims of clinical negligence. It will also harm the NHS's work on patient safety, will probably cost the taxpayer more overall and will certainly add significantly to the NHS bill. That is why even the NHS Litigation Authority wants legal aid kept for clinical negligence. For more details read AvMA's briefing.
