COVID-19 Clinical Negligence Protocol 2020

The Clinical Negligence Protocol came into effect on 14th August and has been signed by NHS Resolution, SCIL and AvMA. The protocol has been designed so that individual firms do not need to sign up to it.

The protocol provides for suspension of the limitation period in all clinical negligence cases; it is intended that the protocol will endure and will only come to an end once all the organisations who are party to it give notice – please read the protocol document carefully for full details.

Practitioners are invited to email us and let us know if they are experiencing any difficulties with the way the protocol is operating in practice. Please let us have details of any concerns before Thursday 15th October which is when our first 8 weekly meeting with NHS Resolution takes place.

At the moment NHS Resolution has agreed the protocol, however we are keen to encourage other defence organisations to agree to conduct clinical negligence litigation in accordance with the protocol we will update you with any developments as they occur.
